What is probate?
Probate is when you prove that a will is valid and are legally recognized as the executor of an estate. It is often a necessary step before distributing the assets of the deceased.
What if there is no will?
If the deceased did not leave a will, or if their will did not name an executor, you would have to obtain a grant of administration instead of a grant of probate. Rather than an executor, you would be the estate’s administrator.
