Spousal Support

Spousal support may be payable if a prenuptial, separation, cohabitation agreement or a court orders it to be paid. A person’s eligibility to pay or receive spousal support depends on the circumstances of the marriage and the financial situations of the parties. Married couples can apply for support under either the Divorce Act or the Family Law Act, whereas common-law couples can apply under the Family Law Act.

The Spousal Support Advisory Guidelines provide an idea of how much spousal support is payable, as well as the duration of the payments. It is important to meet with a lawyer to determine which factors may make you eligible to receive spousal support.
