Divorce

Divorce is the only way to legally end your marriage. To obtain a divorce order, you must provide proof of the marriage, the reason for marriage breakdown and, if there are children, proof that reasonable arrangements are in place for the children. You can establish marriage breakdown in one of three ways: one year of separation, adultery, and physical or mental cruelty.

If the divorce is uncontested, that means that the spouses have agreed on issues such as spousal and child support, property division and parenting responsibilities. If it is contested, that means that the parties cannot agree about issues such as parenting, support and property division.
